PRA and Chilean Free Market Think Tanks launch Open Letter to Protect IP

La Property Rights Alliance participó gratamente en un encuentro con Think Tanks liberales chilenos (Instituto Libertad, Libertad y Desarrollo, Instituto Res Pública, Horizontal y Fundación Jaime Guzmán) para hablar sobre la importancia de la certeza jurídica y de la protección de los derechos de propiedad industrial e intelectual en la búsqueda del desarrollo económico, el aumento de las inversiones y el aumento de la innovación. Actualmente en Chile, estos derechos están siendo amenazados, especialmente en la industria farmacéutica, donde las autoridades están comenzando a impulsar las licencias obligatorias para algunas enfermedades como la Hepatitis C en el Proyecto de Ley Fármacos II. Esta política pública no solo disminuye las ganancias de los inversionistas, la inversión en innovación, sino que también perjudica a los consumidores creando y permitiendo la piratería, disminuyendo investigaciones cruciales para resolver problemas actualmente urgentes. En esta oportunidad, se destacó la evidencia sustancial existente en la materia, como, por ejemplo, que los países con protecciones sólidas sobre los derechos de propiedad tienen más altos índices de Producto Interno Bruto per cápita en comparación con aquellos países que tienen protecciones más débiles. Lamentablemente, a veces las autoridades a cargo de estas políticas públicas ignoran la evidencia y prefieren priorizar otros objetivos que ponen en peligro la protección de los derechos de propiedad, los cuales tampoco serán alcanzados ante la inexistencia de fundamentos sólidos para los derechos de propiedad. Al final, la protección de los derechos de propiedad industrial e intelectual es fundamental para proteger y promover nuevas creaciones únicas y de vanguardia provenientes del intelecto humano inspirado por la creatividad y asegurar que ellas serán compartidas de manera justa con los demás ciudadanos para construir una mejor nación. Los emprendedores solo dedicarán su tiempo y su esfuerzo a crear si es que saben con certeza que sus futuras invenciones serán protegidas por la ley y la institucionalidad existente. Los responsables de las políticas públicas chilenas deben comprender cuán importantes son estos derechos, no solo para promover el crecimiento económico y el desarrollo, sino que también para mejorar el bienestar humano.

The Property Alliance gladly participated in a coalition letter with liberal Chilean Think Tanks (Instituto Libertad, Libertad y Desarrollo, Instituto Res Pública, Horizontal y Fundación Jaime Guzman) to talk about the importance of the legal certainty and the protection of intellectual and industrial property rights to move the country towards economic development, higher investment and finally the increase of innovation. These rights are actually being threatened in Chile, especially in the pharmaceutical industry, where the authorities are starting to boost compulsory licenses for some medical diseases such as Hepatitis C in the Bill Fármacos II. This public policy not only diminishes investors earnings, but also hurts consumers creating and allowing piracy to flourish and slowing down crucial researches needed to solve current urgent problems. In this opportunity, it was highlighted the substantial evidence supporting those claims, as for example, how countries with robust protection of property rights have better per capita Gross Domestic Product than countries with weaker protections. Sadly, sometimes authorities in charge of these public policies ignore evidence and prefer to prioritize other projects that jeopardize the protection of property rights searching for other objectives, which will not be achievable if there are not solid foundations of property rights. At the end, the protection of industrial and intellectual property rights is fundamental to protect and promote unique cutting-edge creations of human intellect inspired by creativity and ensure that they will be shared fairly with other to build a better nation. Entrepreneurships will only dedicate their time and effort to create if they are sure that their inventions will be protected by the law and the existing institutionality. Chilean public policy makers need to understand how important these rights are to promote not only economic growth but also better human welfare.
